Terms of Service
Version 2.0 · Last updated 5 October 2026
These Terms of Service (“Terms”) are a binding agreement between you and Arcteligent LLC, a Wyoming limited liability company (“Arcteligent LLC”, “we”, “us”), which operates BespokeQR at bespokeqr.com (the “Service”). Please read them carefully. Our Privacy Policy explains how we handle personal information and is part of these Terms.
Section 20 requires most disputes to be resolved by binding individual arbitration, and waives class actions and jury trials. You can opt out within 30 days of first agreeing to these Terms.
Each section starts with a plain-English summary to help you read it. The summaries are not part of the legal terms; if a summary and the full text differ, the full text applies.
1. Acceptance and eligibility
You accept these Terms and our Privacy Policy when you tick the box saying you agree (at sign-in, at checkout, or when we ask you to agree to an updated version), or when you use the Service. If you don’t agree, don’t use the Service.
- You must be at least 18 years old and able to form a binding contract. The Service is not for children.
- You may use the Service for personal or business purposes. If you use it for a business or other organization, you confirm you have authority to bind it, and “you” includes that organization.
- You may not use the Service if doing so is prohibited by the laws that apply to you, if you are on a U.S. government sanctions or denied party list, or if you are located in a country subject to a comprehensive U.S. embargo.
- You’re responsible for your account and everything done with it, and for keeping access to your email (which we use to sign you in) secure. Tell us promptly at legal contact email if you think someone else has accessed your account.
2. Definitions
- “Service”: the BespokeQR website and app, the Short links and redirect service, design tools, exports, emails, and related services we provide.
- “Code”: a QR code you create with the Service, including its design.
- “Short link”: the BespokeQR web address encoded in a Code (for example bespokeqr.com/r/ABC1234). We host it, and it forwards people who scan the Code to the Destination.
- “Destination”: the web address you choose for a Code’s Short link to forward to.
- “Preview”: a Code that hasn’t been bought or added to a paid plan. Previews are not live (section 5).
- “Credits”: units in your account used to pay for AI image generation in the Service (section 8).
- “Lifetime”: the operational life of the Service, as explained in section 3.
- “Plan”: a lease (a monthly or annual subscription) or a lifetime purchase for one or more Codes.
- “Content”: anything you provide to the Service, such as prompts, text, logos, images, brand details and Destinations.
- “Output”: designs, images and files the Service generates for you.
3. What “lifetime” means
“Lifetime”, “for life”, “own it” and similar words, wherever they appear (on our website, in our marketing, at checkout and in the app), mean the operational life of the BespokeQR Service: the period during which we operate it. They do not mean the life of any person, business or product, or any minimum period.
- A lifetime Plan is a one-time payment for one Code. While we operate the Service, that Code’s Short link keeps forwarding to the Destination you choose, with no recurring fee, and it doesn’t pause for billing, subject to these Terms (including suspension and termination under section 19).
- A lifetime Plan includes the features of the lifetime Plan you bought, as described at the time of purchase.
- You don’t own the Short link, our domain or our software. A lifetime Plan gives you the right to use them for that Code as described in these Terms.
- A lifetime Plan ends when the Service is discontinued (section 4) or your account is terminated (section 19).
- Converting a lease to lifetime: we credit what you’ve paid on the lease, up to 3 months of its monthly price, toward the lifetime price. The lease stops billing once it covers no other Codes.
4. Discontinuation of the Service
We may change, suspend or discontinue all or part of the Service at any time, for any reason.
- If we decide to discontinue the Service entirely, we will make reasonable efforts to tell you in advance by email (to the address on your account) and, where practical, to give you time to download your data and design files.
- When the Service ends, every Short link stops forwarding to its Destination, including Codes on lifetime Plans, and your access to the Service ends.
- Credits of every kind (purchased credit packs, monthly plan credits, and credits included with lifetime Plans) are never refundable and never redeemable for cash or anything else of value, including when the Service is discontinued. They can only be used on the BespokeQR website while it operates, and they end when it stops operating.
- If we discontinue the entire Service before the end of a lease period you have already paid for, we will refund the unused part of that period’s lease fee. Apart from that, lifetime Plans and other payments are not refunded on discontinuation.
- To the fullest extent permitted by law, we are not liable to you or anyone else for changing, suspending or discontinuing the Service or any part of it.
5. Free previews
- Every new Code starts as a Preview. You can design it and see watermarked previews of the design.
- A Preview is not live. Its Short link never forwards anyone to your Destination; people who scan it see a neutral “not live yet” page. While signed in, you can open your own Destination from that page to test it.
- A Preview becomes live only when you buy a Plan for it or it joins a paid Plan you already have. Don’t print or publish a Preview and expect it to work.
- Free preview rounds and other free allowances are limited, and we may change them at any time. We may delete Previews (including their designs) at any time, for example after a period of inactivity, without notice.
- There’s no obligation to buy anything. Previews are provided “as is” with no commitment of any kind.
6. Plans, billing and automatic renewal
Plans. We offer leases (monthly or annual subscriptions that cover a number of Codes) and lifetime Plans (a one-time payment for one Code). What each Plan includes is shown on our pricing page and at checkout when you buy.
Price and payment. The price, the billing frequency, and the fact that a lease renews automatically are shown before you pay. Payments are processed by Stripe. By buying a lease, you authorize us (through Stripe) to charge your payment method for the first period and for each renewal until you cancel. Prices don’t include taxes unless we say so; you’re responsible for any applicable taxes.
Automatic renewal: your lease renews automatically at the end of each billing period (monthly or annual, as you chose) at the then-current price, and your payment method will be charged, until you cancel.
- Cancelling. You can cancel a lease at any time online in Account → Manage billing (our Stripe billing portal), or by emailing legal contact email. Cancellation takes effect at the end of the current billing period: your Codes stay live until then and you won’t be charged again.
- No partial-period refunds. We don’t give refunds or credits for partial billing periods, unused time or unused features, except where the law requires or as stated in sections 4 and 7.
- Changing plans. You can switch plans or billing interval in the billing portal; any price difference or proration is shown before you confirm.
- Price changes. We may change our prices. For an existing lease, we’ll tell you by email at least 30 days before a new price applies to your next renewal, so you can cancel first. If you don’t cancel, the new price applies from that renewal.
- Failed payments. If a renewal payment fails, your Codes keep working for a 7-day grace period and we tell you by email and in the app. If it’s still unpaid after that, scans show a neutral “paused” page until payment goes through. We may retry the charge.
- Chargebacks. If you dispute a charge with your bank or card issuer instead of contacting us first, we may suspend your account and the affected Codes (or all your Codes) while the dispute is open, and terminate them if the dispute is decided in your favour. Please contact us first; most problems can be fixed quickly.
7. Refunds
- Leases: non-refundable, including partial periods, except where the law requires or as described in section 4.
- Credit packs: non-refundable (section 8).
- Lifetime Plans: you can ask for a full refund within 14 days of purchase if both of these are true: (a) none of the credits included with that lifetime purchase have been used, and (b) the Code has not yet forwarded any scan to its Destination (it hasn’t been “activated”). Email legal contact email from your account’s email address with the Code’s Short link. If we refund, the Code goes back to being a Preview and the credits included with it are removed. If you converted a lease, the refund is the amount you actually paid for the lifetime Plan. After 14 days, or once either condition no longer holds, lifetime purchases are non-refundable except where the law requires.
- Our mistakes: if we charged you in error, contact us and we’ll correct it.
- Your legal rights: if the law where you live gives you a right to cancel, withdraw or get a refund that can’t be waived, nothing in these Terms takes it away.
8. Credits
- What credits are. Credits are a limited, revocable license to use certain features of the Service, such as AI image generation. They are not money, a deposit, a stored-value product or a gift card, they are not your property, and they have no cash value.
- Where they come from. Monthly plan credits (with some leases), credit packs you buy, credits included with some lifetime Plans, and any promotional credits we choose to give.
- What things cost. Each action shows its credit cost before you start (for example, the cost of each image depends on the AI model used). A design round reserves the credits for all its images up front. We may change credit costs for future actions; the cost is always shown before you spend.
- Automatic returns. If an image fails to generate or doesn’t pass our scan check, its credits are returned to your credit balance automatically, and if a cheaper fallback model is used, the difference is returned. Returns go back to your credit balance; they are never paid out as money.
- Monthly plan credits are added at the start of each monthly period while the Plan is active, reset each month and don’t roll over: whatever is unused at the reset expires. Spending uses monthly plan credits first.
- Purchased and lifetime-included credits don’t expire while we operate the Service, subject to sections 4 and 19.
- Credits are non-refundable and non-transferable, and are never redeemable for cash or anything else of value. They can only be used on the BespokeQR website while it operates. You can’t sell, trade or move them to another account.
- Forfeiture and corrections. If we terminate your account for breach of these Terms, fraud or abuse, your Credits are forfeited. We may correct a credit balance that is wrong because of an error, a reversed payment or abuse.
9. Scan verification
Definition. “Scan-verified”, “verified to scan”, “verified scannable”, “scan-checked” and similar words mean that, when the design was created (or a file was exported), our software decoded the image to the exact Short link using standard QR decoding software, at the sizes we state (for example full size, 400 and 200 pixels wide), and that it met our minimum contrast check.
- It is not a guarantee that a Code will scan after printing or in any particular situation. Results depend on print size and resolution, the printer, ink, paper or material, finish and gloss, colour reproduction, lighting, distance and angle, curved surfaces, dirt, wear or damage, the phone, its camera and scanning app, and any changes made to the file. Light-on-dark (inverted) designs may not scan with some older scanner apps.
- Test before you print at scale. You are responsible for testing a printed sample on several common phones before printing in quantity or publishing, and for printing at or above the recommended size.
- Printing costs. To the fullest extent permitted by law, we are not liable for printing costs, reprints, materials, installation, lost business or any other loss caused by a Code that doesn’t scan.
- A PDF footer such as “Scan-verified by BespokeQR · date · opens example.com” records when that file was decoded and the Destination’s domain at that time.
10. Link checks and daily monitoring
The Service checks your Destination when you set or change it, shows a “Verified” panel for each Code, checks the Destinations of live Codes about once a day, may email you if a Destination fails repeated checks, and may email you when a Code first goes live.
- Best effort only. These checks are a convenience. We don’t guarantee how often or when they run, that they are accurate or complete, or that they will detect a problem. Checks can be delayed or skipped, and can report problems that don’t exist or miss ones that do (for example, when a website blocks automated requests).
- No uptime guarantee. We don’t guarantee that the Service, any Short link or any Destination will be available.
- To the fullest extent permitted by law, we are not liable for missed, late, incorrect or false alerts, or for not alerting you.
- Your Destination is your responsibility: its availability, content, legality, security and accuracy, and keeping your Codes pointed at the right place.
- Our checks identify themselves as automated requests, and you agree that we may make them to your Destination. We may change, limit or stop these checks at any time.
11. Destinations and acceptable use
You are solely responsible for every Destination you set and all content at it, and for all Content you provide. You must not use the Service, a Code or a Destination for:
- anything illegal, or that promotes or facilitates illegal activity;
- malware, phishing, scams, fraud, credential or payment-data harvesting, or other harmful software or schemes;
- content that sexualizes or exploits minors in any way (we report apparent child sexual abuse material to the National Center for Missing & Exploited Children and to law enforcement);
- sexually explicit or adult content;
- harassment, threats, bullying, hate speech, incitement to violence, or publishing someone’s private information;
- infringing anyone’s copyright, trademark, privacy, publicity or other rights, or selling counterfeit goods;
- deceptive redirects: misleading people about where a Code goes, impersonating any person or business, cloaking, or switching a Destination to something materially different from what the printed context leads people to expect in order to deceive them;
- spam or unsolicited bulk messages;
- interfering with the Service: probing, scanning or testing its vulnerabilities; scraping; overloading it; getting around limits, rate limits, plan features or payment; reverse engineering it (except where the law allows); or creating accounts by automated means or multiple accounts to abuse free previews or Credits;
- building a competing product or service using the Service; or
- anything else that violates any law or regulation, including consumer protection, privacy, export control and sanctions laws.
What we may do. We may, at our discretion, without notice, refund or liability: screen Destinations (including through Google Web Risk and similar services), refuse a Destination, pause a Code, send its scans to a warning or neutral page, disable it, remove Content, suspend or terminate your account, and report activity to the authorities. We are not obliged to monitor Codes or Destinations, but we may. Report abuse to legal contact email.
12. Your content, logos and uploads (and DMCA)
- You keep ownership of your Content.
- Your promises. You confirm that you own, or have all the rights, licenses and permissions needed for, everything you upload or enter, including logos, brand names, images and text, and that your Content and Destinations don’t infringe anyone’s rights or break any law.
- License to us. You grant Arcteligent LLC a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transmit, adapt (for example resize, remove backgrounds, or turn a logo into a silhouette), render and display your Content, and to send it to our service providers (including AI providers), as needed to provide, secure and improve the Service and to comply with the law. The license lasts while your Content is in the Service, plus a reasonable period for backups to expire. We don’t use your Content to train our own AI models, and we don’t use your designs in our marketing without your permission.
- Our screening of logos and prompts for well-known trademarks is best effort. We may refuse or remove any Content at any time. You indemnify us against claims that your Content infringes anyone’s rights (section 18).
Copyright complaints (DMCA). We respond to notices of alleged copyright infringement under the U.S. Digital Millennium Copyright Act. Our designated agent is: DMCA designated agent: name, address and email (to be registered with the U.S. Copyright Office). A notice must include: (1) your physical or electronic signature; (2) identification of the copyrighted work; (3) identification of the material you claim infringes, with enough information for us to find it (for example the Short link); (4) your contact details; (5) a statement that you have a good-faith belief the use isn’t authorized by the owner, its agent or the law; and (6) a statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorized to act for the owner. If we remove material, the person who posted it may send a counter-notice as the DMCA allows. We terminate the accounts of repeat infringers in appropriate circumstances. Knowingly false notices can create liability (17 U.S.C. § 512(f)).
13. AI-generated art
- AI art in the Service is generated by third-party AI models from prompts (including prompts we write or expand from your idea). It is generated for you rather than taken from a stock library, but AI models can produce similar output for other people, so we can’t promise that any Output is unique.
- Copyright. Material generated by AI may not be protected by copyright in the United States or elsewhere. We make no promise that you can register or enforce copyright in any Output.
- Your rights. As between you and us, to the extent we have any rights in Output generated for you, we assign them to you when it is created, and you may use that Output for any lawful purpose, including commercially, subject to these Terms and any third-party AI provider terms that apply. We keep the right to store, display and process Output to provide the Service (for example your design history and re-renders).
- No warranty of non-infringement. We don’t warrant that Output doesn’t infringe anyone’s rights or is accurate or suitable for any purpose. Check Output before relying on it, especially for important brand uses. Our trademark screening of prompts and logos is best effort and can make mistakes in either direction.
- Style designs (no AI) are produced by our software from our presets; you may use the resulting Code designs, and the presets themselves remain ours (section 14).
14. Our intellectual property
- The Service, its software, the Style Engine, presets, templates, look and feel, the BespokeQR name and logo, and the Arcteligent Labs name are owned by Arcteligent LLC or our licensors and are protected by intellectual property laws.
- We grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for its intended purpose, in line with these Terms.
- You may use, reproduce, print and display the Code design files you download (including designs made with our presets) for your own Codes. You may not resell, redistribute or repackage our presets or templates as a product, or use them to build a competing service.
- If you send us feedback or suggestions, we may use them freely without any obligation to you.
- All rights not expressly granted are reserved.
15. Third-party services
The Service depends on third parties, including Cloudflare (hosting, storage and network), Supabase (database and sign-in), Stripe (payments and billing), Resend (email), OpenRouter and AI model providers such as Google and Anthropic (AI generation and screening), and Google Web Risk (link safety). Their own terms may apply to you (for example Stripe’s, when you pay). To the fullest extent permitted by law, we are not responsible for their services, outages, changes or actions, or for any third-party website, including any Destination.
16. Disclaimer of warranties
To the fullest extent permitted by law, the Service, all Codes, Short links, Output, link checks and everything else we provide are provided “as is” and “as available”, without warranties of any kind, express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and that the Service will be uninterrupted, secure, error-free or that any Code will scan or any Destination will load.
Some jurisdictions don’t allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
17. Limitation of liability
To the fullest extent permitted by law, Arcteligent LLC and its members, managers, employees, contractors and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any lost profits, revenue, business, goodwill or data, or printing or replacement costs, arising out of or relating to the Service or these Terms, however caused, even if we were told they were possible.
To the fullest extent permitted by law, our total liability for all claims arising out of or relating to the Service or these Terms is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, and (b) US$50.
These limits apply to every legal theory (contract, tort including negligence, statute or otherwise) and even if a remedy fails of its essential purpose. Some jurisdictions don’t allow certain limitations of liability, so some of these limits may not apply to you; in that case our liability is limited to the fullest extent the law allows. Nothing in these Terms limits liability that can’t be limited by law, such as liability for fraud or for death or personal injury caused by negligence.
18. Indemnification
To the fullest extent permitted by law, you will defend, indemnify and hold harmless Arcteligent LLC and its members, managers, employees, contractors and agents from and against all claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising out of or relating to: your Content; your Destinations and anything at them; your uploads, logos and brand materials; your use of Codes and Output; your breach of these Terms; or your violation of any law or anyone’s rights. We may take control of the defense of any claim, and you will cooperate with us.
19. Suspension and termination
- By you. You can stop using the Service at any time, cancel leases as described in section 6, and ask us to delete your account at legal contact email. Payments are not refunded except as described in sections 4 and 7.
- By us. We may suspend or terminate your account, any Plan or any Code, with or without notice, if: you breach these Terms; we suspect fraud or abuse; a payment fails or is disputed; continuing would expose us, our providers or others to legal, security or reputational risk; we are required to by law; or a Preview has been inactive for a long time.
- Effect. When an account or Code is terminated, its Short links stop forwarding to their Destinations (scans see a neutral page), your access ends, lease billing stops, and Credits are forfeited if the termination is for breach, fraud or abuse. No refund is due when we terminate for any of those reasons, including for lifetime Plans.
- Sections that by their nature should survive termination do so, including sections 3 (as to its meaning), 4, 7, 8 (as to non-refundability), 9–18, 20, 21 and 23.
20. Dispute resolution and arbitration
Please read this section carefully. It affects your legal rights, including your right to go to court and to a jury trial.
- Informal resolution first. Before starting arbitration or a court case, the person with a claim must send the other a written notice describing it and the relief sought (to us at legal contact email; to you at your account email), and both sides must try in good faith to resolve it for 30 days. Time limits for bringing claims are paused during this period.
- Binding arbitration. If the dispute isn’t resolved, any dispute, claim or controversy between you and Arcteligent LLC arising out of or relating to the Service or these Terms (including their formation, validity, scope or enforceability) will be resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, before a single arbitrator. The Federal Arbitration Act governs this section. Questions about whether a dispute must be arbitrated are for the arbitrator, except as stated in (d) and (g).
- Fees and place. Filing and arbitration fees are paid as the AAA Consumer Arbitration Rules provide. If you show that the costs of arbitration would be prohibitive compared with going to court, we will pay as much of them as the arbitrator considers necessary. Hearings may be held by video or phone, or in the county where you live, and the arbitrator may award the same individual relief a court could.
- No class actions; no jury. You and we may bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated or representative proceeding. The arbitrator may not consolidate claims of different people or award relief to anyone other than the individual parties. YOU AND WE WAIVE ANY RIGHT TO A JURY TRIAL. If this class-action waiver is found unenforceable for a particular claim, that claim (and only that claim) must be decided by a court, and not in arbitration.
- Exceptions. Either side may bring an individual claim in small-claims court if it qualifies, and either side may ask a court for an injunction to stop infringement or misuse of intellectual property.
- Mass filings. If 25 or more similar arbitration demands are filed against us by or with the help of the same lawyers or organisation, they will be administered in batches under the AAA’s mass arbitration procedures, to the extent the AAA rules allow.
- Public injunctive relief. Where the law doesn’t allow a claim for public injunctive relief to be arbitrated or waived (for example under California law), that claim will be decided by a court after any arbitrable claims are resolved, and is paused until then.
- 30-day right to opt out. You can opt out of this arbitration agreement by emailing legal contact email within 30 days of first agreeing to these Terms, from your account’s email address, saying that you opt out of arbitration. Opting out doesn’t affect any other part of these Terms, and arbitration agreements you’ve made with us before still apply.
- Changes. If we make a material change to this section, it won’t apply to a claim you notified us about before the change took effect, and you may reject the change by emailing us within 30 days of it taking effect.
21. Governing law and venue
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law rules, and the Federal Arbitration Act governs section 20. Any dispute that isn’t subject to arbitration (or small-claims court) must be brought only in the state or federal courts located in Wyoming, and you and we consent to their jurisdiction and venue. This doesn’t deprive you of the protection of mandatory consumer-protection laws of the place where you live, where those laws apply.
22. Changes to these Terms
We may change these Terms from time to time. For material changes, we will notify you by email or in the app at least 30 days before they take effect, and we may ask you to agree to them again. Changes needed for legal reasons or for new features may take effect sooner. If you continue to use the Service after changes take effect, you accept them; if you don’t agree, stop using the Service and cancel any lease. The version number and date at the top show which version is current.
23. General
- Entire agreement. These Terms, the Privacy Policy and any plan details shown at checkout are the entire agreement between you and us about the Service and replace any earlier agreements on that subject.
- Severability. If any part of these Terms is found invalid or unenforceable, it will be limited to the minimum extent necessary and the rest stays in effect (except as section 20(d) provides).
- No waiver. Not enforcing a right isn’t a waiver of it.
- Assignment. We may assign or transfer these Terms, including in a merger, acquisition, sale of assets or reorganization. You may not assign or transfer them without our written consent.
- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control, such as natural disasters, war, terrorism, civil unrest, labour disputes, government action, epidemics, power or internet failures, cyberattacks, or outages of our service providers.
- Notices and electronic communications. You agree to receive agreements, notices and other communications from us electronically, by email to your account address or in the app, and that these satisfy any requirement that they be in writing. Notices to us must be sent to legal contact email.
- Relationship. Nothing in these Terms creates a partnership, joint venture, employment or agency relationship.
- Headings and summaries are for convenience only and don’t affect how these Terms are interpreted.
- California users. Under California Civil Code section 1789.3, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (800) 952-5210.
